Legal Question in Entertainment Law in Pennsylvania

Album Art Question

I am designing album art for my band's debut album. I would like to use an image of a star map, which originally appeared in an atlas from 1660. Is this legal? I assume such an old painting would have passed into public domain, but I wasn't sure. Also, exactly what credit or attribute would I need to include?

Also, I would like to slightly alter the painting using a image program - basically overlaying the band and album title but also perhaps enlarging certain sections. Are there laws concerning alterations of antique paintings? Thanks for your help.

Re: Album Art Question

You asked about copyright.

Ancient works are generally in the public domain. If the actual image you intend to use has been enhanced by another party then that may be copyrighted, but the original 1660 image would be public. You may do anything you want to alter or enhance the ancient image and you do not even need to attribute the work, but it would be respectful.

If your band needs an attorney I would be happy to speak with you.

Regards,

Roger
