what is the age for a child to make a choose on which parent to live with

I have two children that live with their father in endeavor Pa. for the past 7 years and have always wanted to come home to live with their mom. But he hates me so much he is not going to allow that to happen and he punishes the children for me leaving him. they have suffered enough and told me they can't take no more. I have a lawyer and have been fighting him for almost two years and not getting anywhere, I need help. please help them. Tim is 12 and Alicia is 9.Tell me how to fight the system in that small town. I think they are all crooked. help us please

This does not appear to be a Tennessee case. Under the Uniform Child Custody Jurisidiction Enforcement Act, Pennsylvania has been the home for the children and would have home state jurisidcition. I do not have the information to address Pennsylvania law on your question
