Legal Question in Family Law in Pennsylvania

My brother has had his daughter since March. The mother was in Jail. She has recently been released. She had her parents lie to my brother about her release. The grandmother setup my brother. She asked if she could have my niece a day early for a visit. ( He has been more than fair with her family). They never brought her back. What can my brother do since they do not have a custody agreement?

He needs yo file for a custody.order.Clearly he isn't dealing with less than honorable people.
