Legal Question in Family Law in Pennsylvania

Child Abandonment?

Father and Mother of child have never been through the courts for child support nor custody. Parents are not married. Father of child is not active (has seen child a handful of times in the past 6 yrs). Can the Father's rights be signed over (by the court) without his consent for abandonment? Father has history of violence and even tried to hide child from mother threatening child's life... would this be considered when Mother tries to get full custody w/o Father's consent? It is known that Father will NOT sign over rights.

Re: Child Abandonment?

Unless the child is to be adopted more than likely he will not get his parental rights terminated. Besides it would terminate father's duty to pay child support.

First thing mom needs to do is file for a confirmation of custody. This will establish an enforceable court order that spells out when and under what conditions father will see the child.
