Legal Question in Family Law in Pennsylvania

child visitation

I have 2 kids, no custody order, and a kids father who owes 20000 in arrears. He has now decided that he wants visitation rights and has hired a lawyer. I tried to file for a custody agreement months ago but did not have a current address to serve him with the papers. When I tried to allow informal visitation in the spring he would tell the children that he would be there and never show up to get them. I have documentation of pretty much everything. he is now calling and harrassing me and telling me that his lawyer is going to slaughter me in court. When i tried to file harrassment charges w/ the cops tonite they said they had bigger crimes to worry about and wouldnt even take a report, even though he is calling me repeatedly.I told him to stop calling and let the courts work it out. I will not let him speak to them because he badmouths me. I don't know what to do.

You need to consult with a lawyer to properly assess your situation. i assume you are not married if so is a divorce pending. You should establish custody by having a court order. As it now stands you have no stronger custody rights legally then the father. Since you have ben the custodial parent this would most likely not be an issue. The father of the child unless he is a danger to the child would most likely receive some type of visitation. I assume you have a support order, Why have you not presued a contempt action for failure to pay support. If you would like to consult with my office then contact me.
