College expenses

I just read the response to Postsecondary...., here's my

Q:

Doesn't the Constitution govern all states? How can it be unconstitutional for PA residents to file for postsecondary educational costs and support and not unconstitutional in others? Particularly because current PA financial aid regs require income from the ''custodial'' parent AND step parent in aid determinations for students under the age of 24yrs (while support obligations end at 18yrs.). Nothing is required from the ''non-custodial'' parent.

It was held unconstitutional under the PA Constitution. I found a couple of cases where that section of the code was found to violate the equal protection clause. See Curtis v. Kline (appeal of Dep't of Pub. Welfare), 542 Pa. 249 which also cites Blue v Blue.
