can the father of my child sue for custody. my son is two years old and he has not even seen him since he was three months old. he pays child support

Whether or not he pays child support doesn't affect his rights to custody other than it establishes that he is the father of the child. As such yes he could file a petition to enforce his custody rights. Whether he does or not is up to him. However, you could file for a custody order as well.
