If there is no custody order, then no, it would not be illegal to keep the child from either parent. While there is no custody order, both parents have equal rights to the child, which means that either parent can prevent the child from seeing the other.

I would suggest that you retain a lawyer right away so you can get a custody complaint filed and get visitation re-established or begin the process of seeking shared or primary custody (depending on the facts of your case).
