Legal Question in Family Law in Pennsylvania

I am leaving my husband

I have been with my husband for 14 yrs. We have three kids together, the youngest is three. I have put up with a lot of crap in the last 10 yrs and I don't want to make my children suffer any more. We bought a house together seven yrs ago. Both names are on the deed. It's much eaiser for him to leave the house then for me to uproot three kids when I have nowhere to go.

He refuses to leave the house. Can I legally make him? Or do I have to take my three children to live on the streets? He could care less if we did.

As part of a divorce action you can file a petition for exclusive possession of the marital residence. How successful such a petition might be would require more facts than you have presented.

If you have any questions feel free to contact me, the initial consultation is fee.
