Legal Question in Family Law in Pennsylvania

What is Pa divorce law regarding two people who have been living a part for almost two years. When can i get him off my insurance?He is dragging the divorce out. He says he only has 300.00 to pay the lawyer so it can be filed?

The waiting period is 2 years in PA if one spouse does not consent. If both spouses consent, you can be difvorced in 90 days. Divorces can be bifurcated from other issues like child custody/support or equitable distribution.

If he consents but doesn't have the money to file, then why can't you if you are anxious to be divorced? Go to a family lawyer. If there are no assets/debts and no children, many counties allow you to file divorce without a lawyer and there are pro se (do it yourself divorce kits). While I think its better to have legal counsel, it can be done and you only have to pay the filing fee. If you are really poor and cannot afford it, then apply to the court to file in forma pauperis (that's latin for as a poor person). You can also seek out legal aid if you qualify.
