I'm considering divorcing my husband. If I leave our home, which is in both names, prior to filing for divorce do I forfiet my rights to procedes of the home and it's contents? Do I have to file first then leave. What are my options. I don't want to file and have to live with him till I find new quarters due to his verbal & mental abuse. I have two adult childre (19 & 21) that will have to put up with it also.

You will not lose your right to the proceeds if you leave and you do not have to file for divorce first.
