reform custody different states

4 yrs ago my ex got custody of our 3 kids through lies in court. Anyways now they seem to be the ones doing everything they said I was doing. My children are not being fed properly, things are taken away from them,and their stepmother is the only one ever home with them, my ex is never home, or if he is he is sleeping. My kids get very disturbed and upset when they have to go back home after our visits. During they tell me how little they get to eat, usually frozen pizzas and garlic bread. One of my daughters has a disease that requires exams every year which their father hasn't not provided the entire time he has had custody.Right now I live in a different state then he does. My question is, my new husband has a great job in New Jersey, and my ex lives in Pa, 6 hrs away. Would it be better for us to stay here with the great stable job, or move closer to them to fight for custody?

Unless you move into PA, you would have to file a Petition to Modify the custody order, as well as a Petition to Relocate them out of state. I would raise the care and supervision issues, and if the lack of medical treatment for your daughter is of a urgent nature, I would not heistate to act. If you can prove what you are stating, and the children support it, you would have a chance at changing physical custody, regardless of your proximity. Other factor will include the amount of time you now see the kids, as well as the kids' ages and preferences as to where they want to live.
