Relocation and divorce

I am considering relocation to Florida and would like to know what if my ex-husband can stop me in any way. We don't have a formal custody agreement at the present time. We both live and were divorced in Pa. My relocation does not involve job relocation, just a change in lifestyle.

Generally, one parent may not relocate with the children unless such relocation is in the best interests of the children. Since there is no court order in place, you would not be violating any order to relocate. However, he can seek a temporary order from the court preventing you from leaving until the matter can be heard.

You have two choices. You can simply take the children and see what he does. You can file your own action in court seeking an Order that gives you custody and allows you to relocate.
