removing spouse from home

I would like to have my husband move out so we can start divorce procedures. We have 6yr. twins and I would like to remain in the house with them. We rent this home. When I asked my husband to leave he point blank said ''no''. Can he do that? I don't want to remove the twins from their school so I can't go anywhere. What can I do.

The only way to compel your husband to move out, is by way of a protection from abuse action, if the situation warrants it, ie. he is abusive and your are fearful, or by filing the divorce complaint, and part thereof, request "exclusive possession" of the marital residence.
