Spite is her motive

My 2 children live with their mother. My oldest (7) tells me her mother smokes marijuanna regularly. I also know that she does cocain. She lives in public housing with a girlfriend that doesn't belong there. My daughter misses a lot of school usualy because the mother doenn't wake up in the mourning early enough and the school is literaly accross the street. The mother keeps my children from me because she is angry at me for not wanting to be with her. (she is violent) she lied and said i was abusive and placed a pfa on me wich has been completed. I just want my children to be with me, as they want to be with me more than they want her. I cant afford a lawyer.

That may be her motive but, to prevail in a child custody case you have to show that it is in the best interests of the child to be with you.

The fact the child lives with mom and not you. Further, the PFA works against you.

All is not lost but expect a long and costly battle if you seek to modify custody.
