Unwelcome Abusive Stepdaughter

In the community property state of Pennsylvania, the wife and stepfather willingly bring the wife's daughter and grand- daughter into their home to assist them during a time of financial hardship. It is now five years later, and the stepdaughter has become verbally and physically abusive to the stepfather having actually struck him once. The stepfather and his wife are soon to file for divorce. The husband wants the stepdaughter out of the house he owns jointly.

What are his rights? Can he force the stepdaughter out if the natural mother does not agree?

The fact situation you present is quite difficult and you should consult an attorneyfor a complete evaluation. As a Pennsylvania attorney, the following lawsshould be noted. We have a protection fromabuse act, which can forceably remove someone from a property if there are abusive acts being committed. The woman is a guest in your home and in my opinion can be thrown out or evicted without the consent of the other spouse. However, more facts are needed before such advice can be given. As a practical matter you may want to move out anyways because of the pending divorce. That is a practical solution.
