Legal Question in Medical Leave in Pennsylvania

Employer w/ less than 50 employees

A client of mine is re-writing her employee manual. She has much less than 50 employees and owns a private practice. She insists that they have rights under the Family Medical Leave Act, is this true and if so, what are they?

The last time I researched it for a close to

50 employee company, all remedies are tied to

the 50 employee cutoff. The same rules apply

for counting as with the 15 employee limit for

Title VII. Therefore, an employee of such a company has

no enforceable rights under the act. Your friend

is just inviting confusion and resultant expence by

implying that her employees have rights that they in

fact do not have. However, if she wishes to provide

a similar job benefit on a voluntary basis, she could

do so. I would advise making this clear.
