Auto accident...other persons fault...his insurance company refuses to pay

my car was hit going through an intersection at a local mall, my car was damaged, his truck was not, I won't go into detail but it was not my fault. I was all the way through the intersection when the front driver side of his truck hit the passenger side of my car. After chasing after his insurance company for 2 weeks I received a call saying they refuse to pay, because he says it wasn't his fault. If someone would have taken the time to look at my vehicle or the intersection, they would see that there is no way at all the accident could be blamed on anyone but him. Do I have any recourse, short of taking him to civil court, I have only limited tort on my car and can't afford to fix it, but I don't think it will pass inspection without it being fixed.

Well; do you mean you have no collision insurance? If you were not injured then limited tort does not figure in this. If you were injured then forget the following: If the other driver was at fault get a good estimate of the damages; send the estimate to the other driver and demand that it be paid. If he does not pay you'll have to go to the MDJ and file suit against him. If you do have collision give the claim to your insurance company. That's what you pay for. They'll give you a check and pursue the other driver for the damages and the deductible.
