Case against employer

My previous Employer is one of the top 10 companies in India and listed in NASDAQ as american company. I worked for that company for around 7 years and resigned one year before and joined another company. I haven't got my final settlement so far and i have been following up for the last 15 months. They are not denying that but telling that finance guy is in vacation and telling some or other reason. I'm totally stressed out. I have sent atleast more than 50 follow up emails, but no luck so far. Also, my gratuity is pending from them..Can i file a case against that company? What are the evidences that i need? Pls let me know.
