Legal Question in Civil Litigation in Pennsylvania

Flooding

Our basement and back yard has been flooded several times in the past 3 months. It hasn't happened before this summer. There are several farmers who own fields near our house that have installed underground pipes with holes in them to drain off their fields...... the last time it rained I watched a stream of water trail down their road and into our yard. We have a drainage ditch out back that was installed by the city a while ago, but they haven't kept it up and it has deteriorated. Whenever we get a heavy rain, water over flows the ditch and in our yard. Are the farmers and the city both financially responsible for the flooding? We've allready had to replace out water heater and furnace due to the flooding of our basement.

Re: Flooding

If you can establish that the farmers and the City's actions have contributed and are the proximate cause of your loss, you can pursue your claim. You must notify the City within six months of the loss in writing. Experts need to be hired and you should obtain the services of an attorney as soon as possible. If I can be of any assitance, please let me know. Gerald Hershenson 215-579-9390
