Friendly Promise

A friend was driving an uninsured vechile,there was an accident involing the vechile he promised to pay for the damages due to the fact he was already in a similar situation,he nows refuses to pay for damages stating that because the vechile was not insured at the time the owner is at fault.At the time of the accident he did not want any law involved, the vechile was not drivable and was towed away by a friend and is in storage.What legal steps can the owner of the vechle persue to seek money for damages done?

The vechile is not paid off owner has been and is still making payments to bank.
