Shopping Cart Damage

While I was shopping in a popular toy store my car was damaged by a shopping cart. The cart was in the way of a woman who was attempting to navigate through a very crowded parking lot. She got out of her car, shoved the cart out of her way, and drove out of the parking lot. The cart then slammed into my car, taking off the passenger-side rear-view mirrow and causing dents and scratches. This was all witnessed by an employee of the store who wrote down the liscense plate number of the woman who pushed the cart. The store employee also took pictures of the damages. The township police informed me that they could not pursue the woman because she had no malicious intent to damage my car and they also told me that it was the responsiblity of the toy store to compensate me for the damage to my car. The toy store claims it is not their responsibility. Who is responsible for the damage done to my car?

While the driver may not be criminally responsible, she is certainly civilly liable.

I am not sure how much damage her act caused, but, it well may be worth pursuing civilly.
