What requirements does Pennsylvania have about giving a marraige license to a couple, one of whom is illegal. He has a passport, but no SSN or visa.

Re: Marriage to an illegal alien

You asked about marriage to an illegal alien.

There actually is no residency requirement or other need to prove legal presence in order to get married in PA.

That doesn't mean the alien is home free. The alien must still go through a visa process but instead of seeking a permanent residency the citizen spouse can petition for a spousal visa. It is not an effective tool to get married just to get residency. There are too many barriers and a sham marriage could result in deportation and exclusion of the alien and prison for the spouse. On the other hand, if there is a legitimate relationship then by all means, find an attorney, before you get hitched and start the process.

Good luck,

Regards,

Roger
