question

hi my name is--name removed--my boyfriend has a sick child in ecuador with cerebral palsy i want to know if there is a way i can help him bring his child? Can the child be approve for a visa

Hello,

To accurately answer the question I would need to know your boyfriend's status as well as yours. Based on your question I will assume he is here on a Visa and you are a citizen, and try to answer.

If this is the case, there is little you can do as a non-family member. He can apply for a Visa for his child. All you can do is allow him to list you as a place of residence or support for the child during her stay.

If you marry him, your options broaden. As your husband, you can apply to sponsor him and his child for permanent residency. He can then file based on your sponsorship, and if approved, a Visa will be issued for the child.

Aside from marrying him, the only idea that comes to mind is, if one of the child's parents relinquishes their parental rights, you can adopt the child in Ecuador. Then, as an adoptive parent, you can Petition USCIS for an orphan petition. If approved, they will grant a Visa for the child to enter the U.S. This would likely be a lengthy process.
