Legal Question in Insurance Law in Pennsylvania

Auto Accident

My son was involved in an auto accident. My son was making a left hand turn from the highway to a parking lot. The other driver pulled out (left) and hit my son's driver side door, which sustained quite a bit of damage. The other driver admitted fault at the scene. The police were not called. Both exchanged insurance info. We find out that the other driver's insurance policy with Nationwide expired this past April. Through research, I found that the family has a policy with AllState but this particular vehicle is not covered under the policy. I do not have a phone number for the other party. I do have an address - if it is correct. What legal recourse do we have in this matter. Thank you.

most likely, the household auto policies would cover this incident. You need to make a claim against those policies. Was your son injured?

That depends. If you want to go about it the proper way you should get all your dcuks in a row and then present the information to the police department local to the area where the accident occurred. You can also obtain an accident report online.

After this report has been filed you can ask police to provide the parties information. You can also obtain this through some of your own investigation.

Send a registered and certified, return reciept requested to the other party requesting payment or insurance information. If they don't respond then you will have to sue. Assuming that your son obtained the license plate information you can obtain the current information from the police or Motor Vehicle Department.
