Legal Question in Insurance Law in Pennsylvania

auto accident

a, supposed, stolen rental car totaled my car while my car was parked in a restaurant lot. rental company states their insurance company is not libel and will not pay for the damage to my car. what recourse do i have? person who was driving the rental car and hit my car was involved in a shooting and was wounded prior to hitting my car. all parties in this incident have been arrested. i am out the car and balance owed on the car. i did not have collision insurance. i used a personal loan to purchase the car. what can i do?

Unfortunatley you probably can't do too much. If the person at fault was driving without the permission of the owner or renter, the rental co is not responsible. If the driver had his own auto ins (not likely) he would probably be covered, unless his policy had an exclusion for criminal acts, if he was in the process of committing such an act. You can always sue the other driver, but if he's not insured it's unlikely you will recover anything from him personally. But it never hurts to get a judgment. Possibly he will post bail & you may be able to attach the bail money. But it's a long shot. Good luck!!
