The value of the car to replace it about 6000.00 Nationwide will pay 3110.00

The Defendant's insurance company's obligation is only to pay you the fair market value of the car, not the repair value, when the car is a total loss. If you want to keep the car and get it repaired, you will have to get a "salvage title" after the repairs are made (so that when you sell the car, the buyer knows your car has been in a bad wreck). Getting a salvage title is a pain in the butt!
