Legal Question in Insurance Law in Pennsylvania

damage

My 12 year old grandson got angry and broke a chair at his day care providers. They told him he could go to jail if he did not pay $100.00 for it or he could work it off. He takes perscription medication for allergies. They suggested one of the things he could do was to dust and vaccum and do dishes. Can they make him do it?

They can certainly make him (or you) pay for the damages. They cannot make him work it off.

They can make the child's parents/guardians pay for the chair, but they can not make him 'work it off'. It strikes me that you are asking the wrong question. You should be asking how the 12 y.o. had the guts to destroy someone else's property. I think you should take a piece of the chair and smack his ass with it and tell him each time he damages someone else's property he can look forward to the same treatment. I'd worry more about the behavior problem and less about the allergy problem.

Personally I'd have offered to pay for the chair right off and admonished the child in front of the biggest audience I could find.
