Legal Question in Insurance Law in Pennsylvania

limited tort rights

I was hit in the rear, car is totaled by appraiser. State police told me I needed to go to Hospital because the impact was so bad. Hospital said cervical sprain and low back pain. Given med's to help. My insurance co. says I have limited tort option and can't get anything beyond medical and car reimbursement. my time off from work i can't get paid for, it's not covered, but I was told by the police i have to go to court, more time off. And what if there are problems later relating to this accident?

Re: limited tort rights

The limted tort law takes a lot of explaining. May I suggest you call me so I can explain it to you and see if it really applies in this case. There are some exceptions. Richard Teitell, Esquire. 610-668-6424.

Re: limited tort rights

Because you have limited tort coverage, you are unable to recover non-economic damages such as pain and suffering, unless you have a "serious injury", or unless certain exceptions apply, such as the other driver was convicted of DUI or is from out of state. You can, however, recover economic damages such as lost wages and medical expenses, not covered by other insurance. As for time missed because of court, you generally cannot recover lost wages.
