I am employed as a nurse manager at a long term care facility owned my a major provider. I have been asked to transfer to another facilty and additional 15 minutes away as a lateral move with the intention to train me to become a director of nursing. I was told that I have no choice, that I must transfer. I have no interest in becoming a director of nursing, transferring to another facility farther from my home or leaving my current position. What I want to know is can I say no?

You asked if you can refuse a transfer.

The particulars of a situation would govern. Generally there is no property right in a job. Employment IN PA is at-will meaning that either the employer or employee can terminate the relationship at any time. The only exception would be if the employer acted in unlawful discrimination of the employee's rights.

As a general rule you would not have a cause of action for a change in working conditions. You might however have reasonable cause to claim unemployment compensation (constructive termination) should you terminate employment.

The best bet is that you negotiate with your employer.
