Nursing home called to say audit revealed we were due a $3,000 refund of deposit after my father died in 2009. They have not sent refund and will not return calls.

And why is this a landlord tenant issue?

If your father died in 2009, was an estate probated for your father? Is the estate closed? It may be necessary to re-open the estate. If a refund was owed in 2009, when did you learn about this? Could any statute of limitations (4 years in PA if that is where your father resided prior to his death in most cases; his death may have reduced this period).

I think you need to see a probate lawyer to see if (a) the monies can be reclaimed and (b) if so, get the lawyer to re-open the estate if need be and then send a letter on behalf of the personal representative to the nursing home demanding the refund. The nursing home can ignore you but they are not likely to ignore the lawyer.
