What is the procedure when someone ''falls'' in a rental property in the bathtub. A tenant is claiming that they fell in the tub and are threatening to sue. She complains of ''headaches'' She called an ambulance and was taken to the hospital. What is the landlords position is she doesn't have Insurance. They are in the process of eviction and this fall coincided at the same time as the court date.

Absent negligence on the landlord's part, for example you knew the tenant was elderly and had requested a grab bar and the landlord didn't put one in. That might get them somewhere other than that what's the cause of action.
