Legal Question in Legal Malpractice in Pennsylvania

Missinformation on bankruptcy!!

What is the liability of laywer or law firm for giving incorrect,misleading or incomplete information. I was told that as soon as I filed bankruptcy the house I owned was now longer mine and that I had no more responsiblities concerning it I have since learned that that was false. It is now 3 years later and the bank still hasn't forclosed. I could have had the house rented for the last 3 years. I've gotten tickets and arrest warrants for not mowing the lawn, shoveling the snow, and not fixing the sidewalk. And the fincance company that has the mortgage has continually harrassed me for payment, what can I do?

I am not a bankruptcy lawyer, however it does sound like the lawyer gave you bad advice, or mishandled the bankruptcy. Once you declare bankruptcy, you no longer have to pay most debts, however you do have an obligation to safeguard the value of assets which might be part of the bankrupcy estate, including your home. If your lawyer told you to simply walk away from the property, I believe he was wrong. i know many people who have declared bankruptcy, and continued to live in their house until it was sold. I suggest you consult a lawyer who specializes in bankruptcy law to get some answers. If your original lawyer was negligent, and you incurred damages, you might be able to sue him. Remember--I am not a bankruptcy lawyer, and only a bankruptcy lawyer can give you intelligeny answers to your questions.
