Re: Birth Defect ??

The general answer is: it depends. The 'normal' statute of limitations for medical malpractice is two years, but there are certain cases in which it is extended. For example, the statute of limitations sometimes begins when the plaintiff first discovered the malpractice.

There's no way I (or anyone else here) can give you a solid answer without a detailed review of the facts. The best way to know is to contact an attorney as soon as possible. My firm handles medical malpractice cases, so you can call us, or you can find lawyers through this website, your county bar association, the Pennsylvania Bar Association, or any other number of sources.

Re: Birth Defect ??

There is a statute of liimitations but its applications and llimits depend upon the facts. I the injuries resulted in death - 2 yrs, If the injuries did not result in death your child has until two years following his 18th birthday. You should conslult an attorney to determine whether the particular facts of your case justify and exceptions.
