Legal Question in Medical Malpractice in Pennsylvania

My daughter of 40 has just past due to mis-use of the drug phentenal. Her history of inappropriate drug use was well documented in the medical community. She had pain to some degree each day as far as I knew. I am her Father. It was also well known for years of her her instability in general when drugs of any kind were in her possession. Her pain management physician was well aware of her addictive personality, her mental problems, and her depression. She at numerous times was 302'd for attempted suicide often using drugs whether prescribed or otherwise to gain a path to her suicidal Intentions. This was all well documented. Hours before her death this doctor wrote a triple prescription for phentanal to this unstable adult with two small children in the home, and my daughter went home after filling 2 of the prescriptions containing 6 patches each and ingested 3 to 4 of the patches by removing the gelatin from the patches.

I feel this medical professional who was taking care of this person should be held responsible for over prescribing this amount of this lethal drug to known drug addict, and mentally un-stable adult.

I need your opinion on this before I turn this case over to a Mal-practice attorney.
