Injury During Surgery

A person who has had a gyn check up and was not told until about a year later that the pap smear was abnormal. Ongoing pain and discomfort has led to a full hysterectomy. Two weeks after the surgery complications that involved infection became very serious for the patient. After two exploratory surgeries one doctor found that during the hysterectomy they irritated the bladder causing perforations that led to a leakage into the stomach causing the infection. Now it has been told that the patient will have to go to a rehab because of the body shutting down from strain and length of time it was fighting.

Is there anywhere in here that would be considered a medical malpractice.

If the pap smear was incorrectly reviewed then this would be malpractice. A further issue would be if early detection would have prevented the hysterectomy. Nicks of the bladder or irritations are not unusual complications of this type of surgury. However, if the surgury could have been avoided, then there may be malpractice. First I would question the delay in the diagnosis of the condition leading to the performance of the hysterectomy. The purpose of regular pap smears is to permit recognition of those problems requiring treatment early so as to avoid the necessity for major surgery such as a hysterectomy. If the surgery was performed for precancerous or cancerous change it may have been entirely avoided by an early diagnosis and treatment that could have been performed in the office. That you weren't told about the pap smear was improper. Howerver earlier smears may not have been accurately read. Whether the complications you sufferred during or as a result of the surgery were preventable can only be deternmined from a careful inspection of the records and research. Certainly this is a matter that deserves being looked into further.
