Legal Question in Medical Malpractice in Pennsylvania

Statue of Limitations?

my dad was in prison for 2 years and was seen by their doctor. He passed away 1 month after he was released. He had throat cancer. He was seen by the prison medical staff dozens of times, but they never diagnosed him. Our family doctor took one look at him and said, ''how can they not know'' what is the statue of limitations for suing the medical staff and prison for neglect? its been a year now.

Re: Statue of Limitations?

The statute is two years from the last date of malpractice, so you have plenty of time to retain an attorney. (In some cases, the statute can be extended under the 'discovery rule' as well.) The standard of medical care in our jails is shockingly bad. It won't get any better until enough people get fed up and start suing.

I'd be happy to get on the phone with you and give you a consultation. Whatever you decide to do, I'm sorry for your loss.
