auto accident

I was rear ended by a drunk driver 5 days ago and I'm still having severe pain i my lower back. I have the ''LIMITED TORT'' option on my insurance. Am I eligible for any pain and suffering?

Yes.

You are not bound by limited tort if the person hit you was drunk.

In fact, you may also be able to receive punitive damages against the person who hit you because they were drunk driving.

Yes. Even if you are limited tort, being hit by a drunk driver is one of the exceptions that permits you to be considered full tort.
