Burnt by ceramic heater

I fell asleep in front of a ceramic heater that was 3 feet away from me. My legs and arm received 2nd degree burns. I did see and was treated by my dr. I have another ceramic heater that I use at work and I have my legs practically on top of it and it doesn't burn me. Do I have a case?
