Legal Question in Personal Injury in Pennsylvania

my daughter had a car accident in april. she hit two bushes on someones property and they are dying. we called the people that week to see how we could come to some agreegment for compensation. no response. Now i get in the mail a bill for $3700 for repairs including "damange to homeowner's property front of home. Cut/removal of tall yews. Install (50) 5', 7 gal green giant arbs to approx area 50' x 10'. 8 yds. screened topsoil @ 30/yd. 5 yds. dbl ground mulch @ $32/yd. 50 arbs@ $45 ea. Disposal of debris. Labor" again TWO bushes were damaged. I took pictures and there is a police report which i am sure states the same. It sounds to me like they want me to landscape their whole front yard, which by the way is a total dump. what should be my first step?

Report it to your auto insurance company and let them negotiate with the other side--that's why you buy liability insurance.

Assuming you have a small co-pay, report it to your auto carrier as Rich suggests. The value of the time and aggravation that you are going go through trying to handle this matter outside of your insurance will not justify any savings you expect.

If you insist on handling the matter privately, formulate a value you are willing to pay. Origianlly offer 50-75% of that number. If you cannot resolve the matter for your number, tell the other side you are not willing to pay. It will then be up to a magistrate/district justice to resolve the dispute.
