Legal Question in Personal Injury in Pennsylvania

my daughter was involved in an accident in which the driver of the log truck was charged with driving in the middle of the road. Her insurance has been of little help to her. They told her that his ins. company would be getting in touch with her. They did and got her statement as to how the accident happened. Then she recieved a call stating that his ins. was trying to get the charges rescinded. My daughter called the investigating officer ,as she was not understanding this. The officer told her not to worry about it.Still nothing has been resolved and the latest call she recieved was that a supervisor from the insurance would be contacting her.Shouldn't her insurance be handling this claim or is it up to her to deal with his insurance?

Your daughter should speak with a personal injury attorney as soon as possible. There is no way that an attorney on this forum can give proper advice without knowing all the facts and circumstances of your daughter's accident.

Any medical bills for injuries sustained in the accident should be covered by her Personal Injury Protection (PIP) coverage. The cost of repairs to her vehicle should be covered by her collision coverage. However, this coverage is optional and she may not have paid for it. If that it the case, she will have to assert a claim against the other driver's policy to secure the insurance funds to fix the car. If the other driver is disputing crossing the line, this may take quite some time. Care should be taken not to settle or waive any claim for pain and suffering due to injuries when pursuing settlement for the vehicle damage. Consultation with a qualified personal injury attorney is recommended.
