Legal Question in Personal Injury in Pennsylvania

My son inlaw was injured at his job 8 months ago he did get help from comp board but now want him to accept a settlement of 25000.00. His foot is still not right(thats were his injury was). We live in Pennsylvania so does he. He is not sure that that is fair compensation. Is it?

The value of his claim is driven by 3 factors. 1) How much he was making at the time he was injured. The higher the better. 2) How much he could earn now. The less he could earn now, the more settlement value the claim has. 3) The strength of the medical evidence that he has a partial disability that is ongoing and likely to be long term or indefinite.

It is impossible to give you a good opinion with regard to the settlement value without that information, and more. I have settled many WC cases for around that amount, but $25,000.00 is, generally, in the lower tier of settlement ranges that we see.

It also makes a difference whether the offer is to settle the wage claim or bothe the wage claim and the medical claim.

If they offered $25,000, it's low, and your son can get more! It's impossible to determine how much more w/o speaking with your son to learn more facts. Your son should meet with an experienced work comp atty. Terry McGraw, who replied to your inquiry, is an experienced work comp atty. So am I.
