unlawful death

My sisters boyfriend was killed in a freak accident involving a drunk driver. He is awaiting trial on several felony charges. He helpled support her financialy. Can she file a civil suit ?

Only the dead person's Estate can file suit. If your sister was not a relative, she won't be able to get any money from the suit.

DEFINITELY there is a civil suit there. There are several possible levels of recovery--you can recover against the boyfriend's insurance, the drunk driver's insurance, the drunk driver's estate, and even the bar that served the drunk driver. Possibly. You need to go to an attorney to check this out. She may even be able to claim she is his common law wife, but, again, you need to speak with an attorney because this is a very fact specific matter. Did they rent/own the apt./home toghther? Were they both on utility and other bills, did htey have shared credit cards, bank accounts, pets, etc. Did they have any children together? --- As I said, a lot of questions need to be answered before you can be given a good, reliable answer.
