Legal Question in Product Liability in Pennsylvania

My GM car's engine recently caught fire, since it was a used car 12 years old I thought it was just bad luck. I subsequently received a recall letter from GM warning that my engine may catch fire (exactly how it did). After calling and giving GM the facts I received a very short letter from them telling me that I have no claim. They basesd this on warranty law . Do I have recourse?

It depends on the present market value of the car. To sue GM, you would be wise to retain a lawyer. You would be responsible for filing fees, attorneys' fees and you would probably need an expert witness. In a case like this, the damages recoverable would be the present market value or actual cash value of your car. So you have to make an economic decision as to whether it is worth pursuing in Court.

Another option may be to make a claim through your motor vehicle insurance company, and see if your policy ocvers this type of loss.
