Legal Question in Real Estate Law in Pennsylvania

I co-own a property with my borther. It is a double block. I own one half, he owns the other half. I used to live in my half, he lives in his half with our mother. I moved and now I am renting to my son and his family. He is trying to sue me for rent payments from my son. Can I rent out my half without his permission? Does his suit have merit?

The answer depends on your deed. If the deed says you own it as joint tenants, then you may owe him rent. If the deed says you own the property as tenants in common, then you may not owe him rent. You should take a copy of your deed to a lawyer.
