Damages found after Closing

We purchased a home, had inspection done.

Three weeks after closing after rains we discovered major leak coming under roof line but above window of sun room. Seller disclosed new roof but said did not have any paper work. Also disclosed not being aware of any leaks or damage.

Also, water in basement sink backs up thru hole in floor for toilet, not disclosed either. Do we have legal recourse? Thanks

Pennsylvania has a law that the Sellers of Real Estate need to disclose certian information pertaining to the condition of the property that they are selling. If they do not disclose a condition, they may be liable for the repairs to correct it. In order to succeed in any dispute, you, the Buyer, need to prove that the Seller knew, or should have known about the condition. In order to establish this, you need to get contractors to come in and tell you what the problem is and how long they think it was in existence. Also, you need estimates of the costs of repairs.

One probelm you may encounter with the roof is that you could have asked more questions concerning the new roof. Also, you did have a home inspector that obvouisly missed the leak. In my experience, when there is a water leak, there is evidence of that leak that the home inspector should have picked up.
