Lease Termination

We are closing on a house in Aug. Our current lease runs through May'05. Since we are buying, is there any clause in PA law that releases us from the lease without penalty?

The lease is definitely a binding contract. There may be a lease provision that deals with early departures, which would control this situation. However, many landlords will allow tenants to leave early with usually a two month buyout of the remaining lease term, or they may let you sublet and/or find a replacement tenant. If you cannot limit your rent costs, the landlord must use "reasonable efforts" to re-rent the apartment or lose the right to recover rent from you. Also, if there is anything seriously wrong with the apartment, you may be able to use the lack of habitability to negotiate your way out of the remaining lease term. A lease is a contract and you are liable to pay the amount contained in the lease agreement. Ask your landlord for a release or the right to sublet. There is no statute to relieve you of this responbility. Gerald Hershenson 215-579-9390
