Legal Question in Real Estate Law in Pennsylvania

Mother's House

My mother wants to sign her house over to me so that the state can't take it if she has to go to a nursing home also to avoid any exessive taxes or headaches once she has passed away. Is this a good idea?

Re: Mother's House

There are many things to consider when a parent is transferring ownership of a home. And with only the little bit of information you have given, I can not fully answer your question, but I will say that there is a 5 year look back period for medicaid eligibility. Meaning if your mother needs skilled nursing care in the next five years, she may not qualify because she gifted the house to you. There are many other things that must also be considered and discussed. I do give free consultations, so please feel free to contact me at 412.731.0865. I look forward to speaking with you.
