Partner leaving but not paying

I live in State College, PA. My partner (a guy) and I have been living in an appartment togeather for over a year. On March 11, 2008 I got a text message from him saying that he was moving out. His name was not on the lease, but the owner knew he was living there. He refuses to pay half of March rent $250.00 plus $100.00 I just put down for a cell phone plan the he had disconnected. I told him that I would be keeping his stuff untill I recived payment. I just recently found out that he is going to his lawyer to either district court or to the district magistrate. What are my options in this? and can I fight this?

Wow the man is stiffing you for $250 and can afford to go to an attorney. Assuming there actually is an attorney.

You can only keep his stuff if you file a notice of distraint. He has 5 days from that notice to challenge it.

If you don't give the notice that 5 day time does not start.
