Legal Question in Real Estate Law in Pennsylvania

Property: who owns it and who can buy/sell or remodel it

My eldest sister has recently left the family and our business. She has 2 pieces of property that were put in her name for refinancing purposes that the entire company invested in. How would we go about getting that property back into the general companies name (i.e. buying it off of her, etc.) if she is no where to be found? Can we sue her or seek other legal restitution?

Re: Property: who owns it and who can buy/sell or remodel it

This can present a number of significant problems and must be looked at in detail by a competent attorney.

Rather than an answer that you can't use I will pose a number of questions that you must consider.

Has your sister left purposefully or just disappeared?

Has she left instructions regarding her property?

Has she exercised dominion over the property?

Did she have fiduciary duties to the family or the business?

Has a thorough investigation been done to locate her?

Did she have a falling out with anyone in the family or business?

How would she view a grant of guardianship or conservatorship over herself or her property?

Was there any contractual relationship between her and the property?

Any way, you see where I am going. There are a tremendous number of questions that need to be answered. What you are requesting can be accomplished in a number of manners, but to prevent problems down the road the situation must be handled appropriately.

Please contact me to discuss the matter further.
